Terms of Service

1. Acceptance of these terms

By accessing or using Vioscale, the API, or the vendor portal, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. If you use the service on behalf of an organisation, you represent that you are authorised to bind that organisation.

2. Description of the service

Vioscale is an independent, evidence-based software-intelligence platform. We publish structured facts about software, designed to be read and cited by humans and by AI systems. A separate vendor portal at account.vioscale.ai lets software owners claim and correct their listings. We may change, suspend, or discontinue any part of the service at any time.

3. Accounts and acceptable use

You are responsible for the security of your account and for all activity under it. You agree not to:

• scrape, harvest, or bulk-extract content in a way that abuses the service or breaches these terms or the documented API limits;
• attack, probe, or attempt to compromise the API or infrastructure, or interfere with its normal operation;
• circumvent, disable, or defeat rate limits, authentication, or usage metering;
• use the service to violate any law, infringe others’ rights, or transmit malware.

4. Data and API terms

Facts are provided as-is, for information only. While we work to keep the data accurate and provenanced, you must verify anything important at its original source before relying on it. Our published facts are licensed under Creative Commons Attribution 4.0 (CC-BY-4.0): you may reuse them, including commercially, provided you credit Vioscale and preserve the provenance/source links, and pass this attribution requirement on to anyone you share the data with. The same licence is declared in every API response. Your use of the API is also subject to any plan limits, credit balances, and documentation we publish.

5. Vendor portal terms

Claiming a listing requires genuine control of the associated domain, which we verify. Profile edits are recorded in an append-only audit log. You are responsible for the accuracy of information you submit. Vioscale may moderate, correct, or remove vendor-submitted content, and may revoke a claim, where it is inaccurate, abusive, unverified, or in breach of these terms. No vendor payment can buy rank, placement, or a change to how data is handled.

6. Intellectual property

The service, including its software, design, and the structure and presentation of the data, is owned by Vioscale or its licensors and is protected by intellectual property laws. These terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the service as permitted here. You retain any rights you hold in content you submit, and you grant us the licence needed to host, display, and distribute it as part of operating the service.

7. Disclaimers and no warranty

The service and all data are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Facts may be inaccurate, incomplete, or out of date. We do not warrant that the service will be uninterrupted, secure, or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Vioscale and its personnel will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the service. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the 12 months before the claim or 100 GBP. Nothing in these terms limits liability that cannot be limited under applicable law.

9. Indemnity

You agree to indemnify and hold harmless Vioscale from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the service, your content, or your breach of these terms or of applicable law.

10. Termination

You may stop using the service at any time. We may suspend or terminate your access if you breach these terms, create risk or legal exposure for us, or where required by law. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnity.

11. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections in your place of residence.

12. Changes to these terms

We may update these terms from time to time. When we make material changes we will update the effective date above. Your continued use of the service after an update constitutes acceptance of the revised terms.

13. How we source data, corrections and removals

Vioscale builds each profile from independent, publicly available sources: the vendor’s own website (for example pricing, documentation and security/trust pages), public code repositories and package registries such as GitHub, npm and PyPI, and public developer-community signals. We record a provenance link to the source of every fact. Vioscale is an automated aggregator of publicly available facts: we present observed, dated data with its provenance and a confidence band, not editorial judgements or definitive commercial claims. We index factual data points, not third-party review content, and we do not ingest ratings, reviews, or scores from review platforms. Our crawler identifies itself honestly with a stable User-Agent and honours robots.txt; a site that declines automated access is not crawled.

If you own or represent a listed product and want a fact corrected or your listing removed, email support@vioscale.ai with the listing URL and the change requested (or use our data request form). We aim to acknowledge your request within 5 business days, and to correct verified inaccuracies or honour reasonable removal requests promptly thereafter. We may ask you to prove you control the product’s domain before actioning a removal. Claiming your listing (free) also lets you correct facts directly.
